According to the Enforcement and Bankruptcy Law, even creditors who do not have a court order can apply to the enforcement office to initiate proceedings. When proceedings are initiated, a <strong data-start=\"608\" data-end=\"622\">payment order<\/strong> is served on the debtor. However, if the debtor believes that the debt is not theirs or is invalid for other reasons, they have the right to object within a specified period.   <\/p>\n<p data-start=\"791\" data-end=\"1087\">The proceedings are suspended upon the debtor&#8217;s objection. At this point, the creditor must file a lawsuit to have the <strong data-start=\"883\" data-end=\"909\">objection overturned<\/strong> in order to collect the debt. As of 2025, objections to payment orders and lawsuits to overturn objections are common legal processes for both creditors and debtors.  <\/p>\n<h2 data-start=\"1094\" data-end=\"1116\">What is a Payment Order?<\/h2>\n<p data-start=\"1117\" data-end=\"1291\">A payment order is an official document sent by the enforcement office to the debtor demanding payment of the debt within a specified period. It is issued upon commencement of enforcement proceedings. <\/p>\n<ul data-start=\"1293\" data-end=\"1546\">\n<li data-start=\"1293\" data-end=\"1400\">\n<p data-start=\"1295\" data-end=\"1400\">There are different types of payment orders depending on the type of debt (ordinary receivables, bills of exchange, rent receivables, etc.).<\/p>\n<\/li>\n<li data-start=\"1401\" data-end=\"1469\">\n<p data-start=\"1403\" data-end=\"1469\">The payment order includes the amount of the debt, its basis, and the payment period.<\/p>\n<\/li>\n<li data-start=\"1470\" data-end=\"1546\">\n<p data-start=\"1472\" data-end=\"1546\">The debtor may object within 7 days after receiving the payment order.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1548\" data-end=\"1824\">A payment order has serious consequences that directly affect the debtor&#8217;s assets. If the debtor does not object within the specified time, the proceedings become final and the attachment phase begins. Therefore, taking the payment order seriously is critically important for both the debtor and the creditor.  <\/p>\n<h2 data-start=\"1831\" data-end=\"1861\">Right to Object to a Payment Order<\/h2>\n<p data-start=\"1862\" data-end=\"2008\">The debtor may object to the payment order within <strong data-start=\"1905\" data-end=\"1921\">7 days<\/strong> by submitting a written or verbal objection to the enforcement office. This objection suspends the proceedings. <\/p>\n<ul data-start=\"2010\" data-end=\"2131\">\n<li data-start=\"2010\" data-end=\"2033\">\n<p data-start=\"2012\" data-end=\"2033\">No debt at all<\/p>\n<\/li>\n<li data-start=\"2034\" data-end=\"2060\">\n<p data-start=\"2036\" data-end=\"2060\">The debt has been partially paid<\/p>\n<\/li>\n<li data-start=\"2061\" data-end=\"2095\">\n<p data-start=\"2063\" data-end=\"2095\">The claim has become time-barred.<\/p>\n<\/li>\n<li data-start=\"2096\" data-end=\"2131\">\n<p data-start=\"2098\" data-end=\"2131\">The debt belongs to a different person<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2133\" data-end=\"2169\">may be objected to for such reasons.<\/p>\n<p data-start=\"2171\" data-end=\"2370\">The grounds for the objection must be clearly and explicitly stated. This is because the debtor cannot subsequently raise a new ground for objection. This regulation aims to prevent malicious objections. <\/p>\n<h2 data-start=\"2942\" data-end=\"2976\">What is an Appeal Cancellation Case?<\/h2>\n<p data-start=\"2977\" data-end=\"3143\">The lawsuit filed by the creditor to have the debtor&#8217;s objection lifted is called a l<strong data-start=\"3052\" data-end=\"3078\">awsuit for the cancellation of the objection<\/strong>. This lawsuit allows the creditor to collect their debt. <\/p>\n<ul data-start=\"3145\" data-end=\"3427\">\n<li data-start=\"3145\" data-end=\"3252\">\n<p data-start=\"3147\" data-end=\"3252\">The competent court is the <strong data-start=\"3190\" data-end=\"3216\">district court<\/strong> or <strong data-start=\"3222\" data-end=\"3246\">conciliation court<\/strong> at the debtor&#8217;s place of residence.<\/p>\n<\/li>\n<li data-start=\"3253\" data-end=\"3323\">\n<p data-start=\"3255\" data-end=\"3323\">The lawsuit is aimed at proving the existence and validity of the claim.<\/p>\n<\/li>\n<li data-start=\"3324\" data-end=\"3427\">\n<p data-start=\"3326\" data-end=\"3427\">If the case is accepted, the proceedings will continue and the debtor may face enforcement denial compensation.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"3429\" data-end=\"3620\">The case for the cancellation of an objection is one of the most critical cases in enforcement law, often yielding swift results. It must be filed within the prescribed timeframe to prevent creditors from suffering a loss of rights. <\/p>\n<h2 data-start=\"3627\" data-end=\"3668\">Burden of Proof in an Appeal Cancellation Case<\/h2>\n<p data-start=\"3669\" data-end=\"3766\">The burden of proof generally lies with the creditor.
