Every foreigner has to fulfill the country’s customs and visa procedures before entering Turkey. Although Turkey has visa exemption agreements with various countries, most foreigners must obtain a visa to enter Turkey. These visa types vary depending on the purpose of the trip. For example, there are different categories of visas such as tourist visas, business visas, student visas, etc. The visa application process is submitted to the consulates of the applicant country and the visa is approved upon acceptance of the application.

However, there are also foreigners who do not need a visa to enter Turkey. Turkey has visa exemption agreements with some countries that are not part of the Schengen Area. Under these agreements, foreigners entering Turkey for a certain period of time do not need to obtain a visa. For example, citizens of some European countries can benefit from visa exemption for short-term visits. Visa exemption may not be valid in all cases and is limited to certain periods. Therefore, it is important for foreigners to know the rules and procedures that apply to entry into Turkey.

After entering Turkey, it is also important for foreigners to obtain a residence permit. Foreigners must apply for a residence permit in order to stay in Turkey for a long period of time. A residence permit is a document that allows foreigners to stay in Turkey legally. This permit can be obtained for reasons such as work, education, family reunification. Foreigners must apply to the relevant authorities with the necessary documents for a residence permit application. The duration of the residence permit is usually one year and can be renewed every year.

Residence Permit Applications of Foreigners

The types of residence permits that foreigners apply for in order to reside in Turkey can be broadly divided into two main groups: short-term and long-term. Short-term residence permits are generally granted to foreigners who come to Turkey for tourist purposes, while long-term residence permits are mostly granted to foreigners who apply for reasons such as work, education, investment or family reunification. In order to apply for a residence permit, the applicant must reside in Turkey and be legally present in Turkey for a certain period of time.

The process by which foreigners apply for a residence permit can be complex in some cases. During the application, the foreigner may be asked to provide health insurance, documents showing their financial situation, documents showing that they have a valid reason to stay in Turkey, and sometimes information regarding their residence address in Turkey. These documents may vary depending on the type of residence permit applied for by the foreigner. In addition, the residence permit application is evaluated within the framework of legal requirements and is issued to be valid from the date the applicant enters the country.

After the application for a residence permit is submitted, a decision is made based on the legal status of the applicant. If the application is approved, the foreigner is granted a residence permit and is allowed to stay in Turkey for a certain period of time. If the residence permit is not granted, the foreigner may not be allowed to stay in Turkey and may be asked to leave the country. This is an important step, especially for foreigners who wish to stay in Turkey for a long period of time, and the application process must be carried out correctly.

Work Permits and Status of Foreigners in Working Life

Work Permits for Foreigners in Turkey

Foreigners are required to obtain a work permit in order to work in Turkey. Foreigners who wish to work in Turkey must first apply for a work permit to the Ministry of Labor and Social Security. Work permit applications are applications made for the purpose of working in a workplace in Turkey. These applications are valid for the foreign employee to be employed by the workplace and if the application is approved, the foreigner is granted a work permit. The job position applied for in order to obtain a work permit must be suitable for the foreigner and the workplace must comply with certain quotas and procedures.

The procedure for foreigners to obtain a work permit in Turkey generally consists of two stages. The first stage is the submission of the workplace’s request to employ foreign workers to the Ministry of Labor and Social Security. The Ministry assesses whether the workplace and the position applied for are in compliance with the established laws and rules. The second stage is the individual application of the worker, supported by a request from the workplace. Once the application is approved, the foreign worker obtains a work permit and starts working in Turkey.

Foreigners’ work permit applications take into account the sector of the workplace, the position and the legal requirements for recruitment. Work permit applications may be prioritized due to the need for foreign workers in certain fields. The employment of foreigners in Turkey is important for economic growth, but the working conditions and rights of foreign workers must be carefully protected. Potential problems in the workplace and disputes between employer and employee should be resolved through legal means.

Work Permit and Social Security Rights

Foreigners who obtain a work permit in Turkey must have the same social security rights as Turkish workers. The rights of foreign workers are protected in areas such as social security, health insurance, work accident insurance, pension insurance. Foreigners working in a workplace in Turkey must be included in the same social security system as Turkish workers. Employers are obliged to employ foreign workers as insured. Otherwise, the employer may bear legal liability.

Foreign employees can benefit from health services by participating in the insurance system in Turkey. In order for foreign employees to benefit from these rights, they are required to pay insurance premiums. These premiums are paid jointly by the employer and the employee and are calculated at a certain rate. Regular payment of social security premiums ensures that the retirement rights of foreign employees are also secured.

After obtaining a work permit, the social security rights of foreigners must be respected and their rights must be protected in the event of workplace accidents and health problems. A foreign worker who has a work accident has the same right to compensation as a Turkish worker. Likewise, a foreigner who is dismissed from work can also claim compensation within the framework of labor law.

Foreign Property Rights and Investment

Right of Foreigners to Acquire Real Estate in Turkey

The right of foreigners to acquire real estate in Turkey is regulated with certain limits. A 2012 law granted foreigners the right to acquire real estate in Turkey. However, foreigners must be subject to certain regulations and restrictions in order to exercise this right. For example, when a foreigner wants to acquire real estate in Turkey, the conditions for acquiring real estate in different parts of the country may vary. The right of foreigners to acquire real estate is similar to the rules applicable to Turkish citizens, but there are some restrictions.

The acquisition of real estate in Turkey by foreigners is generally an important investment for the real estate sector. Foreign investors can invest in businesses operating in various sectors in Turkey and these investments provide significant benefits to both the Turkish economy and foreigners. However, it is important to note that foreigners can only buy real estate in certain provinces or regions. In addition, these immovable properties must be suitable for specific purposes.

Deportation and Appeal Process

Grounds for Deportation and Legal Framework

The residence of foreigners in Turkey is regulated within the framework of certain rules and foreigners living within the borders of the country may be deported from time to time for various reasons. The deportation of foreigners in Turkey is governed by various provisions of Turkish law, provided that they do not contravene the Constitution and international conventions. In particular, deportation may be ordered for reasons related to immigration, public order or security. In addition, foreigners whose visa has expired or who do not have a residence permit may also be at risk of deportation.

Grounds for deportation include the presence of foreigners staying in Turkey illegally, committing a crime or harming Turkey’s security. In addition, foreigners who continue to work without a work permit may also face deportation. Furthermore, foreigners who are in Turkey illegally can usually be detained for a certain period of time before being sent back to their country of origin. The deportation of foreigners is a legal practice carried out by the state according to certain procedures.

Appeal Process against Deportation Decision

There is a legal appeal process against the decision to deport foreigners from Turkey. This process can be used when the foreigner believes that the decision is unlawful. Appeals can be made directly to the administrative judiciary. The appeal process allows the legal basis of the deportation decision to be reviewed in terms of its form and content. Through this appeal process, the foreigner can request the annulment of the decision on a legal basis.

The foreigner’s appeal is lodged in a petition objecting to the deportation decision. The appeal must be submitted to the relevant administrative authority or the judiciary. In the appeal application, the deportation decision may be annulled on grounds such as the person has a legal right to stay in Turkey, humanitarian reasons or legal grounds. As immigration and deportation processes in Turkey can be quite complex, the support of a lawyer is crucial.

Appeals against the deportation decision may be concluded before the implementation of the decision is suspended. If the appeal is unsuccessful, the foreigner may be forced to leave Turkey. However, during the appeal process, the legal rights of the foreigner are protected and, if necessary, their repatriation is carried out in accordance with relevant international conventions and local laws.

Acquiring Turkish Citizenship

Turkish Citizenship Application Requirements for Foreigners

Foreigners can apply for Turkish citizenship subject to certain conditions. The Constitution of the Republic of Turkey and the relevant laws set out the rules to be followed in citizenship applications. A foreigner who wishes to obtain Turkish citizenship must fulfill certain conditions during his/her residence in Turkey. Foreigners who wish to stay in Turkey for a long time and continue living here can apply for Turkish citizenship, but they must follow certain procedures.

One of the main requirements for applying for Turkish citizenship is that the applicant must have resided in Turkey for at least 5 years without interruption. In addition, the applicant’s Turkish language proficiency, adaptation to the social and economic rules of the state, and a clean criminal record are also taken into consideration. In addition, the applicant’s health status may also be a criterion for citizenship application. After the application for Turkish citizenship is evaluated by the relevant Ministry of Interior, the applicant’s compliance with the criteria is determined.

When applying for Turkish citizenship, applicants are required to provide a detailed statement of their background and circumstances. The application may request the applicant’s financial situation, place of residence, family and other personal information. There may also be investment or other legal requirements depending on the type of citizenship applied for. The Turkish citizenship application process can usually take several months.

Evaluation and Finalization of Turkish Citizenship Application

The acceptance of the application for Turkish citizenship is evaluated by the Ministry of Interior and the relevant public authorities. If the applicant’s application is approved, the foreigner becomes a citizen of the Republic of Turkey by obtaining a Turkish citizenship number. If the application is rejected, the applicant is notified of the reasons and may reapply if necessary. Foreigners admitted to Turkish citizenship have the same rights as all Turkish citizens, but in some cases, such as dual citizenship, the person may have to take a decision.

Foreigners who acquire Turkish citizenship have the opportunity to exercise their legal rights both in Turkey and in other countries. Turkish citizens can vote in elections, apply for public office and enjoy all social and economic rights in Turkey. However, foreigners naturalized as Turkish citizens may be subject to some special legal regulations, such as military service. These processes may vary according to the social status of the applicant.

Turkish citizenship can only be acquired naturally. However, some foreigners can apply for Turkish citizenship under certain government incentives or investment programs. For example, it has become easier to obtain citizenship for foreign investors who have invested large sums in Turkey. Applying for citizenship by investment has become increasingly popular, especially in recent years, and certain conditions apply to foreigners who wish to obtain citizenship through this method.

Residence Permit

Residence Permit for Foreigners in Turkey

Obtaining a residence permit in Turkey is a legal process that allows foreigners to stay in Turkey for a long period of time. A residence permit ensures that foreigners who come to Turkey can stay in Turkey legally and benefit from various services. The methods used by foreigners to obtain a residence permit vary according to the date and type of application. A foreigner wishing to obtain a residence permit in Turkey must apply for a settlement permit and this application process is based on certain procedures.

After entering Turkey, foreigners are required to apply for a residence permit. Turkey accepts foreigners to reside for various reasons. These reasons include work, family reunification, education or investment. Each type of application has specific requirements and the applicant must submit the necessary documents according to the type of residence permit. For example, a foreign student may apply for a residence permit for study purposes, while a foreign worker may apply for work purposes.

If the residence permit application is accepted, the foreigner is granted a residence permit for a certain period of time, which is usually set as one year.
