What is a Residence Permit and Under What Circumstances Is It Revoked?

A residence permit is an official document that allows foreign nationals to stay in Turkey legally. However, in some cases, the residence permit can be canceled. If the residence permit issued by the Directorate General of Migration Management in Turkey is revoked for certain reasons, the person loses the right to stay in Turkey legally and may face the risk of deportation.

The main reasons that may lead to the revocation of a residence permit are

  • Providing false or incomplete information: Submitting false documents or misleading information during the application.
  • Exceeding the duration of the residence permit: Failure to renew the residence permit after the set period has expired.
  • Pose a threat to public order and security: A person commits a crime or is considered a security threat.
  • Failure to comply with visa or entry rules: Entering Turkey illegally or entering the country despite an entry ban.
  • Engaging in activities that are incompatible with the residence permit: Engaging in illegal activities, for example, working with a student residence permit.
  • Loss of economic sufficiency: When a person becomes unable to support himself/herself.
  • Not being in Turkey for an uninterrupted long period of time: Permanent residence permit holders may be subject to revocation if they have not been in Turkey for a certain period of time.

  • If the residence permit has been completely revoked, he/she must leave Turkey within the specified period.
  • If the administrative appeal or court process is ongoing, the person can legally stay in Turkey.
  • If the person can apply for a new type of residence permit (e.g. a work permit), he/she must reapply according to the relevant rules.

If the person remains in Turkey after the revocation and does not apply for a new permit, he or she may face deportation.

Can I Re-Apply After Residence Permit Revocation?

Yes, you can reapply for a residence permit after it has been revoked. However, in order for the new application to be successful, the reason for the previous revocation must be removed. For example:

  • The application can be renewed by completing the missing documents.
  • If economic viability is ensured, a new application can be submitted.
  • A valid visa can be obtained and the application can be made by re-entering Turkey.

In order for the application to be approved, the process must be followed carefully and the application must be made with complete documents.

Residence Permit Revocation and Deportation Order

In some cases, people whose residence permit has been revoked may be subject to a deportation order. This usually happens in the following cases:

  • The person does not leave Turkey before the expiration of the legal period.
  • Engaging in illegal activities in Turkey.
  • Previous visa or residence violations.
  • Pose a threat to public order.

Persons who receive a deportation order can challenge this decision before an administrative court.

Revocation of a residence permit may result in foreign nationals losing their right to stay legally in Turkey. However, it is possible to appeal the revocation decision and seek legal remedies.

In order to avoid rejection of the application, it is very important to carry out the process correctly from the very beginning, submit complete documents and fulfill the legal requirements. If your residence permit has been revoked, it is recommended that you seek the support of a lawyer for the process to proceed more smoothly.
